Terms of Service

1. Acceptance of Terms

By downloading, installing, or using WineVision ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

WineVision is a mobile application that uses augmented reality and artificial intelligence to identify wine bottles and display wine ratings, tasting notes, and estimated pricing. The App includes features such as wine scanning, wine history, AI-powered chat, and personalized recommendations, subject to your subscription tier.

3. Eligibility

You must be at least 13 years old to use WineVision. By using the App, you represent and warrant that you meet this age requirement.

4. Account and Device Registration

WineVision automatically creates an anonymous account associated with your device when you first use the App. No personal information is required to create this account. You are responsible for maintaining the security of your device and any activity that occurs under your account.

5. Subscriptions and Billing

1. WineVision offers a free tier and premium subscription plans (Plus, Pro) with varying features and usage limits.
2. All subscriptions are managed through Apple's App Store and are subject to Apple's terms and conditions.
3. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
4. You can cancel your subscription at any time through iOS Settings → App Store → Subscriptions.
5. Refunds are handled by Apple in accordance with their refund policies.
6. Prices are subject to change. We will notify users of price changes in advance where required by Apple's policies.

6. Free Tier

The free tier provides limited access to WineVision's features, including up to 3 wine scans per week. Free tier access and limits may be modified at our discretion with reasonable notice.

7. Usage Limits

Each subscription tier includes monthly usage quotas for scans and, where applicable, AI chat messages. When your monthly quota is exhausted, premium subscribers receive a daily bonus allowance to ensure continued access. Usage limits reset at the beginning of each billing period. Certain features, such as rating refresh and vintage correction, count toward your scan quota.

8. Wine Ratings and Information

1. Wine ratings, scores, tasting notes, and pricing information displayed in WineVision are aggregated from publicly available sources and generated by artificial intelligence for informational purposes only.
2. We do not guarantee the accuracy, completeness, timeliness, or availability of any wine information displayed in the App.
3. Wine ratings should not be considered professional advice. WineVision is not a substitute for professional wine expertise or personal taste.
4. We are not affiliated with any wine critics, publications, or rating organizations unless explicitly stated.

9. Acceptable Use

You agree not to:

1. Use the App for any unlawful purpose
2. Attempt to reverse engineer, decompile, or disassemble the App
3. Circumvent or attempt to circumvent usage limits, rate limiting, or subscription restrictions
4. Use automated systems, bots, or scripts to access the App's features
5. Interfere with or disrupt the App's servers, networks, or infrastructure
6. Resell, redistribute, or commercially exploit the App or its content without written permission

10. Intellectual Property

1. WineVision, including its design, code, features, and original content, is owned by Dave Tanquary and is protected by copyright and other intellectual property laws.
2. Wine ratings and critic scores referenced within the App are the property of their respective owners and critics.
3. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DAVE TANQUARY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Dave Tanquary from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from your use of the App or your violation of these Terms.

14. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership, warranty disclaimers, indemnification, and limitations of liability.

15. Changes to Terms

We may modify these Terms at any time. Updated Terms will be posted on this page with a new effective date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the State of Illinois.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dave Tanquary regarding the use of WineVision and supersede all prior agreements and understandings.
